How to Get a U.S. Green Card Through the EB-5 Visa Program
The EB-5 Immigrant Investor Program offers a unique path to lawful permanent residency (Green Card) in the United States for foreign nationals who invest in the American economy. Established by Congress in 1990, this program not only benefits investors and their families but also stimulates economic growth and job creation in the U.S.
Here’s a clear, step-by-step guide on how you can obtain a U.S. Green Card through the EB-5 Visa in 2025.
Step 1: Understand the Investment Requirements
To qualify for the EB-5 Visa, investors must:
- Invest a minimum of $1,050,000, or $800,000 if the project is located in a Targeted Employment Area (TEA).
- The investment must create or preserve at least 10 full-time jobs for U.S. workers within two years.
Step 2: Choose Your Investment Path
There are two main options:
- Direct Investment – You actively manage the business and are directly involved in operations.
- Regional Center Investment – A passive option where your capital is pooled with others in government-approved projects.
Most EB-5 applicants opt for the Regional Center model for its lower management burden and streamlined process.
Step 3: File the I-526E Petition
Once your investment is made, your immigration attorney will help you file Form I-526E, demonstrating that:
- The capital has been lawfully obtained.
- The funds have been committed to a qualifying EB-5 project.
- The project meets job creation requirements.
USCIS typically takes 12–24 months to process this petition, depending on your nationality and project type.
Step 4: Apply for Your Conditional Green Card
If the I-526E petition is approved, you can:
- File for Adjustment of Status (Form I-485) if you’re in the U.S.
- Apply for an Immigrant Visa at a U.S. consulate if you’re abroad.
Once approved, you receive a 2-year Conditional Green Card for you, your spouse, and unmarried children under 21.
Step 5: Remove Conditions After 2 Years
Within 90 days before your 2-year card expires, you must file Form I-829 to prove:
- Your investment remained in the project.
- 10 jobs were created or are on track.
If approved, you and your family will receive permanent Green Cards.
Key Advantages of the EB-5 Visa
- Path to U.S. Citizenship after 5 years of residency.
- No sponsor required — you are your own petitioner.
- Family included — spouse and children under 21 receive Green Cards too.
- Freedom to live, work, and study anywhere in the U.S.
